What Does The Supreme Court Decision Mean For Sex Workers and People in the Sex Trade?
FOR IMMEDIATE RELEASE
Dec 13, 2013 - On December 20, 2013, the Supreme Court of Canada will release its decision on “the Bedford case”. The Bedford case is being fought by three Ontario sex workers to demand that the laws prohibiting sex work be struck down. We stand behind sex workers in their demand for the full decriminalization of our work. What does this decision mean for sex workers and people in the sex trade/sex industry?The three laws being challenged at the Supreme Court are:
a. Communicating For The Purposes of Prostitution in a public place (section 213)
b. Living off the avails of prostitution (section 212)
c. Keeping a common bawdy house (section 210)
Since the introduction of the anti-sex work laws in 1985, there has been a 500% increase in mortality amongst our sisters and brothers in the sex industry. Sex workers and people in the sex trade are our family members, our friends, children, colleagues, partners, leaders and part of our communities. Over our 26 year history, we have seen how criminalizing any aspect of the sex industry hurts all of us. Decriminalization is only one step in the process of achieving our goals of living and working in safety and dignity.
How repealing these laws will increase protection for the most marginalized sex workers1. Repealing the law prohibiting “keeping a common bawdy house”
In the midst of the slaughter of sex workers in the downtown eastside of Vancouver, an Indigenous street-based sex worker—Jamie-Lee Hamilton—opened her own house up so that other sisters in the trade could work indoors rather than disappearing into cars with clients. Women were disappearing, the police were doing nothing and something urgent had to be done. This effort to save lives was shut down by the Vancouver police force using the Bawdy House law—and the massacre of women continued. If the law were struck down, workers could create our own collective workplaces run by and for other sex workers, where we are in charge and protected, where safer sex and services are openly negotiated.
2. Repealing the law prohibiting “Communicating for the purposes of prostitution in a public place”
Upwards of 95% of all prostitution related charges are through this law which primarily impacts street-based (outdoor) sex workers. This law makes being homeless and a sex worker illegal and dangerous. A criminal record has a dramatic impact on someone’s life. Criminal records marginalize those doing sex work due to poverty, can lead to the apprehension of their children and limits other economic options. For the most part, street based sex workers experience the criminal legal system as a source of danger and harassment, not protection. Indigenous sex workers are vastly more likely to experience violence by police and over-incarceration. Repealing this law would be one step to reducing contact between the criminal legal system and sex workers.
Removing this law would remove a significant barrier that sex workers face when attempting to negotiate services, safer sex and assess risk. This is a critical interaction between sex workers and prospective clients that saves lives. Removing this law means that sex workers no longer have to work in areas that are isolated and under-protected, another source of danger.
3. Repealing the law prohibiting “Living off the avails of prostitution”
This laws is purportedly for the protection of sex workers from exploitative pimps and organized crime. In its impact however, it criminalizes all relationships between sex workers and their community, leaving workers without access to colleagues, security, receptionists, community and support. We have reports that boyfriends, managers and friends are often charged under this law based on racial profiling, where men of colour are more likely to be perceived as “pimps” or “traffickers” due to racist stereotyping.
Repealing this law will allow sex workers to make decisions about who they want to work with and will remove one tool of racial profiling used by police.
No More Colonial LawsThe first anti-sex work laws in Canada were in the Indian Act. At the root, all laws in the Criminal Code of Canada were introduced by colonial governments, imposed and are still enforced without the free, prior and informed consent from the care-takers of these lands—the First Nations. There was no assessment nor concern for the impacts these laws have on Indigenous people and nations. As a result, we see that our criminal legal system is bursting with Indigenous people and people of colour who are vastly over-represented. It is the nature of the system to over-police but under-protect certain communities and criminalizing any aspect of the sex industry will put more poor and working-class racialized people behind bars--sex workers, clients and third parties such as management and security. More colonial laws will not rescue us from bad colonial laws. Criminalizing any of us tears communities apart.
Sex workers have the solutions to the problems we face. Among these are honouring treaty rights, affordable housing, respectful healthcare and substance treatment, an end to poverty and an overhaul of the child welfare system. Another is to pull the anti-prostitution laws off the backs of the sex workers who are harmed--not helped—by them. For this decision to truly make a difference in our lives, sex workers must be in leadership roles for all decision making about regulations that impact our safety and livelihood including: zoning and licensing, control over the conditions and locations of our work, human rights and labour rights protections, the right to organize as workers.
Sex work is real work and we demand fair and safe working conditions for all of us including those without status. We stand against the exploitation of all workers and legislation that advances the precarity of labour and creates vulnerability to exploitation. The disregard by the state for the lives of Indigenous people involved in sex work and the over-representation of Indigenous people in the most precarious and vulnerable forms of sex work cannot be separated from the ongoing economic exploitation of Indigenous people, the extraction of resources from Indigenous lands, the ongoing pursuit of profit at the expense of Indigenous communities and environmental protections, and the displacement of Indigenous peoples from land and labour. Our call for labour rights for all sex workers supports the right to self-determination for Indigenous peoples. Sex worker rights are labour rights. Health and Safety for Sex workers is a labour rights issue.

Normally, I think this would be a significant issue and I'd be fully onside with Zann.
However, the image in question was a screen capture of a scene she appeared in on The L-Word.
In other words, it in an entirely "public" image (in terms of being available to the public, but not in the public domain).
Initially, Zann launched a complaint under the provinces new cyberbullying law, but she has just today withdrawn that complaint. She has, however, dropped her Twitter account.
As I said, I would normally side with Zann on this because I believe that everyone has the right to own their image. But in this instance, the image was already public and now Zann seems to not want to "own" her own image.
Is she ashamed of her past? Did she have a bad experience working on The L-Word? Does she regret that she exposed her body on film?
Or does she think she has to live up to some kind of decorum as a member of government?
The thing is, those who voted for her likely knew she was an actress. Many likely knew she worked on that particular show. And they voted her in. They accepted her. Why the need to erase her past?
Because of our current societal views of our bodies, the shame that is forced on all of us, I do understand Zann's concern. However, a government figure should lead and she could make a tremendous statement by telling us all, including those who harassed her on Twitter:
"Yes, that is my beautiful, naked body. That was my career then and now I am a member of Nova Scotia's Legislative Assembly. I am not ashamed, I am proud and I will do a great job in my position."

Normally, I'm not a fan of parades. I've been to too many Canadian winter Santa Claus shiverfests. But when you throw in the word panty in there—along with a so many delicious stories...well I'll line the streets to read her adventures. How did you get into sex blogging?
I didn’t even know what sex blogging was when I started almost four years ago. I wrote about my experiences while following self-help dating books. The blog (now defunct) was snarky and sexy and not the least bit useful for anyone really wanting to get involved in a loving relationship. I used my real name and had to shut that blog down after the men I was dating Googled me and found out about my sexual shenanigans.
I started writing anonymously a little over a year ago as Panty Parade. Off Go the Panties blends personal sexual exploration (and fantasy), advice for would-be erotic writers, and commentary about anything having to do with sex. I no longer follow anyone’s rules. That gets me into trouble from time to time, but I’m okay with that.

I write as Panty Parade on Off Go the Panties and Robin Juliet when not writing for my blog. You can call me doctor if you want—I do have a Ph.D.
What is the most important thing you've learned—of any nature—in your years of sex blogging?
The most valuable lessons I’ve learned came from other sex bloggers. I learned that we have an active, loving, giving, supportive, and open community. It’s very humbling when you ask for something and thirty people you know only through the Internet come running to the rescue.
I’m a relative newbie, so knowing that there’s a world of mentors out there helps immensely now that I’m trying to branch out into erotic fiction.
Do you ever aspire to finding someone and settling down?
I aspire to find someone who will love me to my core and never ask me to settle down.
How are you feeling about the reaction to your piece “How to Get Everything You Want from Casual Sex (Without Hurting Anyone)”.
There are two things going on over at The Good Men Project that I find troubling, but overall the experience has been wonderful. The Good Men Project is incredibly savvy when it comes to social media marketing and getting their word out, and I hope to continue learning from them. The sex and relationships editor, Jackson Bliss, has been incredibly supportive and open to my ideas. I’m learning so much by being affiliated with them.
I had a stylist ask me this very same question a few years ago. Back then I answered: chic, cosmopolitan, and a wee bit mysterious. So those words are out. . . . How about friendly, fastidious, and occasionally frenzied?
What themes and activities are you currently enjoying writing about in your erotica?
I asked the beta readers for my novella, Trouble, if the ending was “happy.” One reader responded, “If you call being alone happy.” I believe the technical term for my writing is dark or gothic erotica. The couples are not in love, nor do they want to be. They’re okay with how their lives are working out even though they don’t look anything like a fairytale.
My main characters in this first book get mixed up in the emotional turmoil that (sometimes) comes with great sex. Can you love the sex without loving the person? Some people can and others cannot. That’s the crux of Trouble.
My second book—I actually wrote a lot of it last spring—is a series of short stories where the emotional (and psychological) undercurrent impacts various couples as they explore their erotic fantasies. I’m calling it Involuntary Reflex because our gut reactions to lovers are often unintentional—we respond much like a funny bone hit with a mallet.
What most catches your eye in a Craigslist ad, and what turns you of the most?
I don’t answer many Craigslist personals anymore because I’d much rather post an advertisement and see what happens. When I’ve responded in the past, it was usually consistent with some of my personal kinks—out of town businessmen who are looking for a little home town hospitality. Panty Parade will keep writing at Off Go the Panties and Robin Juliet will publish more erotic fiction and articles. Trouble will be available in January 2014 and Involuntary Reflex will be out in March. The third book—there are traces of various characters in all three, but it’s not an official series—will be out this fall.

On January 1st, 2014, Oasis Aqualounge will be baring it all in celebration of the New Year with their annual Polar Bear Dip at Cherry Beach. Employees of this upscale sex club, located in downtown Toronto, will be plunging into Lake Ontario fully nude for a quick splash after an evening of festivities. This will be the first of many initiatives in a campaign to make Cherry Beach a clothing optional location.
Oasis Aqualounge welcomes all guests who would join in the fun! The club will be arranging free transportation to and from the beach on Wednesday January 1st, at 12:00pm. The venue will also be hosting a special edition of 'Hot Springs'-a weekly event where single men are welcome to attend and women are free of charge. Any brave participants who are willing to dive into Lake Ontario naked will receive complimentary beverage tickets and a free Day Pass to the club. New Year’s Day will mark the starting point towards making Cherry Beach clothing optional with a series of events and community outreach scheduled throughout the year.

Very interesting examination of sexual fluidity. However, I think Ann Friedman would have done well to look into men who live on the down-low. These are guys who may have attraction to both men and women, but have to live out their sexual desires with men in parks, bathhouses and restrooms. If the point of the article is to say that things are, slowly, changing to greater acceptance of male relayionships, then this important outlet needs to be recognized and not vilified as is often the case.
